Sticitt - User Terms of Use (“User Agreement”)

This Sticitt User Agreement is between you and Sticitt (Pty) Ltd (“we”, “Sticitt”, “us”). Please also refer to the Sticitt Privacy Policy. We may amend this Agreement by posting a revised version on our website, at which point the posted revised version will be effective.

Do not proceed with registering for any Sticitt service if you do not agree with the terms and conditions below. If you are under the age of 18, you are not allowed to register. Your legal guardian can register on your behalf. If you do continue to register you confirm that you are the registered owner of the South African cell phone number used to complete the registration process (if applicable). We reserve the right to close or suspend your Sticitt account if we are unable to verify your information, are unable to comply with anti-money laundering regulations or suspect illegal activity associated with your Sticitt account.

Sticitt is not a bank. Sticitt is a registered Third Party Payment Provider, registered with the Payment Association of South Africa and sponsored by Nedbank Limited, Capitec Bank Limited and Sasfin Bank Limited to provide payment services as part of our offering.

Introduction

"Sticitt Services" refers collectively to

  1. Sticitt’s iOS, Android and web-based payment platform which enables you to perform authorisations and payments for products and/or services from merchants where Sticitt has an agreement with such merchants (“Merchants”) using Sticitt credits held in your Sticitt account (“Sticitt Pay”), and

  2. Sticitt’s iOS, Android and web-based (money.sticitt.co.za) platform which enables gurdians and/or parents to manage their Sticitt account and associated services offered from time (“Sticitt Money”).

In order to use the Sticitt Services, you must be a natural person, and have a valid South African mobile number (one issued by a South African mobile network operator), email address and South African ID number or foreign Passport number. By accepting these Terms of Use you warrant that the provided information is correct and true. In cases where you register on behalf of a dependant, you warrant that you consent to Sticitt storing such dependant’s information in accordance with the POPI act (refer to Handling of minors’ data policy below). In cases where Sticitt offers Sticitt Services through partner applications, you consent that Sticitt may obtain the relevant information disclosed above together with your name and surname from such a third-party provider. Use of Sticitt Services is subject to the below Terms of Use and bounds you by these Terms of Use.

Sticitt Services Overview

To create or access your Sticitt Services you will be verified by either verifying your mobile number through an OTP verification process or by password associated with your mobile number or email address. Where Sticitt Services is offered through a partner’s mobile application, Sticitt reserves the right to use such third-party tokenised authentication for future transactions or access once the initial authentication process has successfully been performed. Where Sticitt Services is used through web applications you can opt to perform tokenised authentication for future transactions once the initial authentication process has successfully been performed.

Sticitt Pay is used to authorise and perform payment for products and/or services from registered Merchants using Sticitt credits. Payment for products and/or services from registered Merchants can only be performed if sufficient credits are available in your Sticitt account. Credits in your Sticitt account are topped up through making an electronic funds transfer or cash deposit to the default Sticitt bank account held at FNB using your dedicated Sticitt account reference (“top-up”). Sticitt reserves the right to deduct all direct bank costs, incurred by Sticitt associated with a top-up of your Sticitt account.

Currently, South African Rands are the only accepted currency for top-up purposes and it will take between 30 minutes and 48 hours for credits to reflect in your Sticitt account from when the top-up was performed. The default Sticitt banking details are available on Sticitt Money or Sticitt Pay or obtainable by sending an email to support@sticitt.co.za.

For added convenience, Sticitt offers instant top-ups that enable purchased credits to immediately reflect in your Sticitt account (“Instant top-up”). Sticitt reserves the right to charge a convenience fee for Instant top-ups, which fee will be clearly communicated and disclosed prior to the processing of an Instant top-up. You can perform Instant top-ups to your Sticitt account through Sticitt Pay or Sticitt Money. By adding a card you provide Sticitt with authority to continuously charge that card to process Instant top-ups. You can remove this authority by removing that card from your Sticitt account through the same process followed when adding that card.

To increase the security of your card transaction Sticitt has partnered with Visa and Mastercard and performs an authentication process through your bank the first time you add a new card. Sticitt never stores your card details and complies with all applicable data protection and privacy laws including the Payment Card Industry Data Security Standards (PCI DSS). Nedbank acts as Sticitt’s acquiring bank for all card processing and transactions are processed through the iVeri payment gateway. For more information visit www.iveri.com.

More methods and currencies to perform top-ups, including Instant top-ups may be added from time to time and will be included in the platforms as referenced above.

Tokens Linked to Sticitt Account

Sticitt includes the functionality to link a physical token to your Sticitt account through Sticitt Pay or Sticitt Money. Physical tokens are offered in various form factors and include, but are not limited to cards and bracelets with the official Sticitt logo printed on the face of such card or bracelet (“Sticitt Token”). Sticitt Tokens are obtained from registered Merchants or Sticitt and linked to your Sticitt account using the 16-digit hexadecimal code allocated to each Sticitt Token. Additionally, a picture, name, daily spend limit and note can be added to each Sticitt Token linked to your Sticitt account, which information will be displayed on the Pay Terminal where the Sticitt Token is presented for payment for products and/or services from registered Merchants.

Specific terms relating to Sticitt Money

Sticitt Money offers you various features to help equip your kids and/or dependents to learn specific money habits from a young age. These features may change from time to time. One of the features offered through Sticitt Money is the saving feature. This feature may not be used for general savings purposes but only for purposes of putting funds aside for future-dated purchases your dependents want to perform.

Sticitt Money also allows you to create sub-accounts underlying your account. You remain the primary KYC entity for all sub-accounts. You have the ability to issue a Mastercard linked to any of your sub-accounts. Your use of any such Mastercard functionality on Sticitt Money is subject to the Access Bank terms and conditions available here.

Responsibilities of User

Sticitt will not be held liable for any losses arising from incorrect payment references used during top-ups and for the avoidance of doubt, Sticitt will not accept any responsibility for any losses arising from top-ups made to bank accounts different to the bank account details referenced in the Sticitt Services and Account Overview section above. It is the user's responsibility to ensure these details are captured correctly during the top-up process and the user indemnifies Sticitt against all losses arising from top-ups to any other bank accounts or incorrect payment references used (Refer to Sticitt’s Unallocated funds policy and Dormant Sticitt Account and User Profiles below). Purchases initiated but not paid due to insufficient credits in your Sticitt account will be cancelled after 4 full days (96 hours) from the date the of first purchase instruction.

Any Sticitt Token linked to your Sticitt account can be blocked and unblocked at any point in time and it remains your responsibility to ensure no unauthorised use of a Sticitt Token linked to your Sticitt account occurs and Sticitt will not be held liable for any losses arising from any such unauthorised use.

Your relationship with Sticitt Merchants

In purchasing products and/or services from any Merchant, you are contracting with the relevant Merchant and the Merchant is thus solely responsible for the fulfilment of all aspects of your purchase. Sticitt Merchants contract with Sticitt and agree that no products and/or services purchased using Sticitt credits may be exchanged for cash. Refunds of Sticitt credit can only be processed if such refund request is logged and accepted with and by the applicable Merchant and Sticitt within 48 hours of the applicable successful transaction. Following this, all refunds are to be arranged between you and the Merchant directly. Sticitt only performs authorisations and payments for products and/or services offered by Merchants and accepts no responsibility for delivery of products and/or services and you indemnify Sticitt against any losses arising from products and/or services incorrectly delivered or not delivered at all.

Unallocated funds policy

Unclaimed funds paid to a Sticitt nominated bank account for purposes of performing account credit top-ups, which funds were paid using a recipient reference other than your 8-digit Sticitt account reference, which remains unclaimed for a period of 5 years from the date of payment, will be written off to a surplus Sticitt fund and will not be claimable by a User after such 5 year period has elapsed. If still within the 5-year period from the date of payment, Users can send a query to support@sticitt.co.za together with their proof of payment if they performed a payment to top-up their account credits and made use of the incorrect recipient reference in order for the credits to be allocated to their applicable Sticitt account.

Dormant Sticitt Account and User Profiles

Aligned to POPIA, Sticitt accounts with no transaction activity will be closed after a period of 6 months and User details with Sticitt accounts that have no transaction activity will be deleted after a period of 6 months. Sticitt accounts with transaction history but no activity for the last 5 years will also be closed. Sticit Pay Accounts with credits and no transaction activity for the last 5 years will go through a closure process where Sticitt will make all reasonable efforts to reach such individuals in order to process a Sticitt account credit refund. Sticitt account credits will be allocated to a surplus Sticitt fund and the associated Sticitt account will be closed if Sticitt is unable to reach such Sticitt account holder after all reasonable efforts were attempted to reach such Sticitt account holder within a period of 5 years since the last Sticitt account transaction. For the avoidance of doubt, account deletion means we delete all personal information associated with that account to ensure alignment with POPIA.

Fees underlying Sticitt Services

Sticitt Services includes paid-for services and will be disclosed to you before you decide to enable any specific features underlying our services. Sticitt reserves the right to deduct any such fees from your Sticitt account or credit/debit card linked to your Sticitt Profile. Sticitt reserves the right to stop any Sticitt Services if your account has a negative balance or if any fees owed to Sticit remain unpaid. All you need to do to ensure this never happens is keep a positive balance in your Sticitt account.

Handling of minors’ data

We value the privacy of all our users, including minors. We only process minor’s information with explicit consent from their applicable guardian. By accepting these terms and conditions, you explicitly provide such consent. Minor’s information will only be used to provide a more personalized service to your dependant.

Please read the following points carefully:

  • Data collection: The personal data we collect will include your dependant’s name, email address, and cellphone number.

  • Data use: The collected data will be used for communication purposes and to provide services tailored to your dependant’s needs.

  • Data sharing: We will not share your dependant’s data with third parties unless it is necessary to provide our services. Any third parties involved will be contractually obligated to protect your dependant’s data.

  • Data security: We have implemented strong security measures to ensure the safety and confidentiality of your dependant’s personal data.

  • Review and refusal of processing: At any time, you can request to review the personal information we’ve collected and refuse any further processing of this data.

  • Right to revoke consent: You have the right to revoke your consent at any time. Upon receiving such a request, we will promptly stop processing your dependant’s personal data. Please refer to our website for the correct form to complete in order to revoke your consent.

No Warranty

The Sticitt service is provided “as-is” and without any representation or warranty, whether express, implied or statutory. Sticitt specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.

Limitation of Liability

Sticitt’s liability is limited with respect to your use of Sticitt Services. Sticitt will not be liable for any losses arising out of or in connection with Sticitt Services (including any networks and servers used to provide the Sticitt service), unless and to the extent prohibited by law.

Sticitt Tokens are used at your own risk and Sticitt will not be held liable for any injury or losses arising from your use or others’ use of Sticitt Tokens linked to your or others’ Sticitt account.

Google API Services User Data Policy

The Sticitt mobile or web payment interface use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

General

Sticitt is not a bank and is not acting as a trustee, fiduciary or escrow for funds paid to perform Sticitt account credit top-ups, we are acting only as a custodian of your account credits. Sticitt credits are not cash and are solely for the purchase of products and/or services from Sticitt Merchants. Funds paid to top-up your Sticitt account credits will not be used for Sticitt’s operating expenses or general corporate purposes and Sticitt will not voluntarily avail these funds to creditors or in bankruptcy proceedings.

Sticitt credits can only be redeemed for cash by sending an email to support@sticitt.co.za with a clear photo of your ID document and proof of bank account details which payment must be made to. Sticitt reserves the right to charge a redemption fee when Sticitt account credits are redeemed for cash which fee might change from time to time but will be communicated to you prior to redemption.

Sticitt reserves the right to withhold any purchase of products and/or services and suspend Sticitt Services if any suspicion of fraudulent activity is present. You acknowledge that Sticitt may access your personal information from applicable partners whom Sticitt has entered into an agreement with to enable Sticitt Services. Sticitt reserves the right to reverse any transactions performed through Sticitt Services if it subsequently becomes aware that transactions originally performed from the User’s bank account did not clear through to Sticitt’s bank account underlying Sticitt Services. Information associated with such reversal can always be obtained from Sticitt for a period of 5 years from the date of the original transaction in question by sending an email to support@sticitt.co.za.

You allow us to take any actions required to ensure the integrity, security and stability of the Sticitt technology and back office. Sticitt utilises cloud network infrastructure and as such your personal information could potentially be stored, partially or in full, on servers located outside the borders of South Africa. By using Sticitt you accept the potential storage of your information outside of the borders of South Africa. Sticitt will not share your information with any third party and will take the best effort measures to ensure the safety of your information. By accepting these Terms of Use you agree that Sticitt may contact you in future by email or phone for marketing, product information or other commercial purposes.
